We Energize Oklahoma Industry

Oklahoma City Appeal Lawyers

Sometimes your case does not end with a ruling. You might be able to file an appeal if you lose a decision, receive an unfavorable verdict or are unhappy with part of a lower court’s ruling.

If you decide to appeal, you want to hire an appeals attorney who is knowledgeable in the area of the law specific to your case. One who is accomplished at research, understands the facts, and is a skilled brief writer.

At Mahaffey & Gore, P.C., we handle appeals of oil, gas and energy law cases in state and federal appellate courts, including appeals from district courts and the Oklahoma Corporation Commission. Founded in 1980, we have a reputation as one of the preeminent energy law firms in Oklahoma.

The Appeals Process

To file, you must be able to show there was a legal error that affected the outcome. An appeal is not a retrial. It is a reinterpretation of the decision or verdict.

The process:

  • Notice of Appeal is filed.
  • Brief detailing why a reversal is necessary if filed.
  • A responding brief is filed.
  • Sometimes the court will decide based on the written brief alone. The court can also allow oral arguments.
  • Court decides if there is a reason for a reversal.
  • If there is a reversal, the case will usually be remanded to the lower court. There it will be decided if a new trial is necessary or if the judgment needs modification.

Can My Case Be Appealed?

There are many reasons for an appeal. The lower court may have applied the incorrect legal standard or misinterpreted evidence. Our attorneys will explain the entire process and help you decide if your case can or should be appealed.
