The Appeals Process
To file, you must be able to show there was a legal error that affected the outcome. An appeal is not a retrial. It is a reinterpretation of the decision or verdict.
The process:
- Notice of Appeal is filed.
- Brief detailing why a reversal is necessary if filed.
- A responding brief is filed.
- Sometimes the court will decide based on the written brief alone. The court can also allow oral arguments.
- Court decides if there is a reason for a reversal.
- If there is a reversal, the case will usually be remanded to the lower court. There it will be decided if a new trial is necessary or if the judgment needs modification.
