We perform due diligence for mergers and acquisitions, and we can review or draft all leases, agreements or transactions relating to oil and gas properties.
Pollution Disputes and Environmental Litigation
Mahaffey & Gore, P.C. represents both plaintiffs and defendants in dispute resolution and litigation over environmental damage to adjoining property or underground resources. Our veteran trial lawyers have extensive litigation experience in environmental matters relating to oil and gas exploration and production:
- Groundwater pollution
- Saltwater pollution
- Leaching
- Damage to trees or loss of crops
- Harm or loss to livestock
- Oil and gas spills
Mahaffey & Gore, P.C. successfully represented oil and gas operators in an important Oklahoma case that was reversed on appeal. In Twyman v. GHK Corp., 2004 OK CIV APP 53, 93 P.3d 51,the Oklahoma Court of Civil Appeals determined that Mahaffey & Gore’s clients should not be held liable for damages to property and the illness and death of cows on a neighboring dairy farm. The appeals court concluded that the jury heard improper testimony, over the objection of counsel, that failed to credibly link the cows’ demise to groundwater contamination from the defendants’ oil well.
In advance of litigation, Mahaffey & Gore, P.C. also provides environmental consulting to oil and gas operators to avoid or resolve issues with adjoining surface property owners over prevention and mitigation of saltwater spills, oil and gas spills, or other pollution.
